1) Overview

These Terms govern your access to and use of our website, online store, and services, including the purchase and delivery of shipping containers and related products. By visiting our site or purchasing from us, you agree to these Terms and our Privacy Policy.

2) Eligibility

You must be the age of majority in your province or territory and capable of entering into a binding contract. You agree to provide accurate, current, and complete information at checkout and when creating an account.

3) Products, grades, and photos

Containers are sold in graded conditions such as One Trip, Cargo Worthy, and Wind & Water Tight. Used containers show cosmetic wear consistent with their grade. Where noted as “in stock Ottawa,” photos are of the actual unit. Otherwise, photos are representative of the grade, size, and features.

Specifications, availability, and pricing can change without notice. We reserve the right to limit quantities, refuse orders, or correct errors that may occur.

4) Pricing, taxes, and payments

Prices are listed in Canadian dollars unless stated otherwise and exclude applicable taxes and delivery unless indicated. We accept the payment methods shown at checkout. Orders are subject to verification and acceptance. If a pricing or availability error is found, we may cancel or adjust the order and will contact you.

5) Financing

Financing may be offered through us or approved third-party lenders. Any financing is subject to credit approval and separate terms. If a financed order is refunded or adjusted, funds are returned to the lender per your financing agreement. Interest, fees, or charges from the lender may be non-refundable.

6) Orders and acceptance

Your order is an offer to buy. We accept by charging your payment method and issuing an order confirmation. We may cancel all or part of an order for reasons including suspected fraud, inventory issues, or errors. If we cancel after charging you, we will refund the affected amount.

7) Delivery, site access, and risk of loss

Delivery options, fees, and estimates are shown at checkout or provided by our team. You are responsible for ensuring safe access and a suitable placement area.

Access requirements

• Sufficient straight-line space, width, and height clearance for the truck and container

• A firm, level surface free of obstacles and overhead hazards

• Gate codes, contacts on site, and any permits if required

If the site is not ready, unsafe, or inaccessible, additional fees may apply for wait time, second attempts, or alternative equipment. Risk of loss and title transfer upon delivery to the shipping carrier or upon placement at your site, as indicated on the order.

8) Final sale and remedies

All shipping containers are final sale. We do not accept returns. If the wrong item or grade is delivered, or a material defect contradicts the stated condition at delivery, contact us within 48 hours at info@seacancanada.com with your order number, container ID, and photos. We will repair, replace, or refund at our option. Delivery charges are not refundable once a unit has dispatched except where the issue is our error.

9) Special orders and modifications

Custom builds and specialty units, including open side, double door, open top, flat rack, reefers, paint, doors, vents, insulation, electrical, and similar modifications are final sale. Lead times are estimates and may shift due to production or logistics constraints.

10) Warranties and disclaimers

Except as expressly stated in a product description or required by law, products and services are provided “as is.” We do not make other warranties, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11) Limitation of liability

To the maximum extent permitted by law, SCC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, loss of data, or business interruption. Our total liability for any claim related to your purchase or use of the site will not exceed the amount you paid for the product or service giving rise to the claim.

12) Indemnification

You agree to indemnify and hold SCC, its officers, employees, and partners harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your breach of these Terms or misuse of the site or products.

13) User accounts, content, and acceptable use

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Do not post unlawful, misleading, infringing, or harmful content. Do not interfere with the site’s operation, attempt to probe or scan systems, or use automated means to access the site except as allowed by our platform.

14) Intellectual property

All site content, graphics, logos, and software are owned by SCC or its licensors and protected by Canadian and international laws. You may not copy, reproduce, distribute, or create derivative works except as permitted for normal shopping and purchasing.

15) Third-party services and links

Our site may link to third-party sites or use third-party tools. We are not responsible for their content, terms, or privacy practices. Any use of third-party services is at your discretion and subject to their terms.

16) Communications and SMS consent

By providing your contact information, you consent to receive transactional emails or SMS related to your orders, delivery scheduling, financing, and support. You may opt out of marketing messages at any time using the provided unsubscribe methods. Standard carrier rates may apply.

17) Force majeure

We are not liable for delays or failure to perform due to events outside our reasonable control, including weather, labour disputes, carrier or port disruptions, acts of government, or other events of similar nature.

18) Governing law and disputes

These Terms are governed by the laws of Ontario and the laws of Canada applicable in Ontario, without regard to conflict of law rules. You agree to the exclusive jurisdiction and venue of the courts located in Ottawa, Ontario. If a part of these Terms is found unenforceable, the remaining parts remain in effect.

19) Changes to the Terms

We may update these Terms by posting a new date at the top. Your continued use of the site after changes means you accept the updated Terms.
